32 year old mother emergently delivers baby that was oxygen-deprived due to a failure to diagnose ruptured membranes, baby subsequently diagnosed with cerebral palsy

Summary: Plaintiff, pregnant x 32 weeks, presented to the Emergency Department of the hospital, having ruptured her membranes. She was examined, found to not have ruptured her membranes, which was negligent, and was released to go home.

She returned the next day in pain presenting with her fetus having no fetal heart tones, whereupon her baby was emergently delivered and resuscitated.

Injury: Plaintiff’s child suffered hypoxia and cerebral palsy

24 year old woman suffered PTSD following birth injury

Summary: 24 year old woman, pregnant with twins, presented to hospital in active labor with non viable twins. Defendants, in delivering Baby A, decapitated Baby A and, in so doing, failed to advise Plaintiff that Baby A had been decapitated nor that the decapitated head of Baby A remained inside Plaintiff. In addition, Defendants, with knowledge that the decapitated head of Baby Williams A remained inside Plaintiff, permitted and allowed Plaintiff to use a restroom while unattended, at which time Plaintiff expelled the decapitated head of Baby A onto the floor of said restroom. Baby B went completely undiagnosed until his induced delivery.

Injury: Plaintiff suffered a chronic depressive disorder with post traumatic stress disorder features.
